New document alleges causes for Berthoud accident
'LARIMER COUNTY - The attorneys for Berthoud teenager Michelle Berra have filed a notice claiming Berra was not the only person responsible for the injuries in a tragic traffic accident last January.
Berra is charged with two criminal counts of careless driving by the Larimer County District Attorney after the SUV she was driving hit the back of another SUV near midnight on January 15.
Berthoud High School wrestlers Tyler Carron and Nikko Landeros were standing at the back of the SUV that was hit. Both boys were getting tools out of the vehicle to change a flat tire. They both lost their legs during the collision.
Michelle Berra's attorneys give new reasons for the accident in previously undisclosed information including allegations about alcohol.
According to the filing:
"Mr. Carron was unlawfully drinking and impaired by alcohol." Carron was the driver of the vehicle that was hit and had stopped in the middle of a two-lane highway to change the tire. The case file, including medical documents, was mailed anonymously to 9NEWS and shows tests on Tyler Carron's blood for alcohol were positive. His BAL or blood alcohol level was 150. Medical experts 9NEWS spoke with say that translates to .15, nearly twice the legal limit for driving. In Colorado, driving under the influence is .08 or higher and driving while ability impaired is .05 to .07.
The filing also states that Nikko Landeros' blood alcohol tested positive, but no numbers are listed. "Mr. Landeros participated and encouraged the conduct of Carron," according to the court notice which resulted in Carron driving on a flat tire for approximately one mile, passing six residential driveways into which he could have safely pulled over.
"Carron was also unlawfully transporting more than one passenger." By law, he was eligible to drive only one other person. There were four passengers in his SUV. The court document also alleges Carron and Landeros "stood in front of the tail lights to the vehicle in such a way as to obstruct those lights from on-coming traffic."'
