No charges to be filed after nude photos taken of students
'CASTLE ROCK – The Arapahoe County District Attorney says they do not expect to file charges after as many as 50 students at a middle school looked at or forwarded nude pictures of other students on their cell phones.
District Attorney Carol Chambers says her office will not file charges but plans to meet with parents and the students to talk about what the consequences of the pictures could be in the future.
The pictures were taken of students who attend Castle Rock Middle School.
"For one juvenile to take a picture of another juvenile is not a crime. For a juvenile to take a picture of themselves, it is not a crime," said Chambers on Thursday during a press conference.
Chambers went onto say that if a juvenile put one of those pictures on the Internet, it is also not a crime.
"There has to be certain intentions involved in taking pictures of underage people," said Chambers.
Castle Rock Police have confiscated 16 phones and one computer, but say one of the photos is now on the Internet after it was e-mailed to a person in California.
Investigators say the students in the photos apparently had their pictures taken as part of a dare and had no idea how many others would ultimately see them.
"What they may have considered innocent fun is going to be used by someone down the line for not innocent fun," said Chambers.
Chambers say they are concerned the pictures will be used by others as child pornography in the future.
Chambers says if their children have their pictures on the phone she says they should take the phone to law enforcement. They will try to get the pictures off and send them over a secure line to the Center for Missing and Exploited Children, which will then to make sure they are not on the Internet.
"Parents need to know if they (their children) have a camera phone, this can happen," said Chambers.'
